Big fine equals trouble in music download case
Music industry has targeted about 35,000 people
MINNEAPOLIS - The $1.92 million verdict against a Minnesota woman accused of sharing 24 songs over the Internet could ratchet up the pressure on other defendants to settle with the recording industry — if the big fine can withstand an appeal.
“Normally in our American legal system, we say the punishment should fit the crime,” said Ken Port, director of the Intellectual Property Institute at William Mitchell College of Law in St. Paul. “Now she’s being ordered to pay, in some ways, an incomprehensible amount of damages.”
Under federal law, the recording companies are entitled to $750 to $30,000 per infringement but the law allows the jury to raise that to as much as $150,000 per track if it finds the infringements were willful.

Pirate Bay founders sent to jail
Also ordered to pay 30m kronor (£2.4m)
A court in Sweden has jailed four men behind The Pirate Bay (TPB), the world's most high-profile file-sharing website, in a landmark case.
Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde were found guilty of breaking copyright law and were sentenced to a year in jail.
They were also ordered to pay 30m kronor (£2.4m) in damages.
In a Twitter posting, Sunde said: "Nothing will happen to TPB, this is just theatre for the media."
Sunde went on to say that he "got the news last night that we lost".
"It used to be only movies, now even verdicts are out before the official release."

Analysis of the 2008 World Videogame Market
Market Changes from 2006-2008
After a 2007 in which Nintendo dominated hardware sales and software sales worldwide, many questioned whether that success would be sustainable into 2008. For many industry analysts, 2007 had been a very difficult year to predict because there were three transitions taking place. Sony’s PS2 was in the process of being replaced by Nintendo’s DS as the top machine for total software sales worldwide. Nintendo determined that it could handle supporting two platforms better than three or four in 2005, and this allowed for all the top software from the firm to concentrate on only two platforms over a period of two years. Sony at the same time had the challenge of expanding its resources to support three platforms, and trying to determine which platforms to place the projects on. The major trend in Japan in 2005 of PS2 dominance waning due to the emergence of DS dominance left the 2006 videogame sales muddled.
In a year when 60 million videogame platforms were sold, Nintendo managed to juggle its four platforms just well enough to grab over 50% of all videogame hardware units sold. For 2007, many expected that a) the market would grow, and b) that with price cuts Microsoft and Sony would be able to drop Nintendo’s share by attracting more mainstream consumers.
The Wii began to explode in 2007, selling over 16 million units and becoming the first console more expensive than PS2 to outsell it in every world market in the same year. Videogame sales did grow tremendously in 2007 though – over 81 million units of videogame hardware sold. DS held firm at 35% of all sales, leading Nintendo’s charge to 55% hardware market share in the year. If Game Cube, Xbox, and Game Boy Advance sales are included as well, Nintendo’s market share jumps up another percent, mainly because GBA sold over 2m units in 2007. Despite Nintendo’s growth in total market share, the change did not really come at the expense of Sony or Microsoft market share, since it was mainly Game Boy Advance, PS2, GC, and Xbox users migrating to the newer machines. In 2008, the expectation was that the videogame market would be up once again, and that as Wii aged and rival machines began peaking, Nintendo’s market share would slip a bit. Instead, it was Sony’s market share which slipped to Nintendo and Microsoft, despite having the most platforms on the market. DS market share did dip from 35% to 32%, but the market grew so much in the year, that its sales were still up from 2007

There’s no glue – just a patented system of tiny clips which fit snugly over the edge of the disc The d_skin's came delivered to us at we at Nintendo life (.www.nintendolife.com) in a rather nifty CD-shaped tin, once inside we got out our Wii and proceeded to "Play It Safe" by applying a d_skin to the most expensive disc we could find, the recently released Wii Fit sufficed as in theory it would cost £69.99 to replace. Standing on our official NintendoLife.com balance board we gave the disc a try, after a cautious entry the disc was graciously accepted by our Wii and to our relief the game loaded and played as normal, phew! We also thought we'd give it a challange by testing out the slot loading drives on our Macbooks, again the d_skin worked as advertised, nice. These results show us we shouldn't of been worried at all, after all the d_skin recently received Time magazine’s ‘Coolest New Invention’ award. Protecting the environment by protecting your CDs
It isn’t perhaps the most groundbreaking news story that reveals persistently replacing ruined CDs can be painfully damaging to one’s bank balance. However, less obvious is the damaging impact that a single chip or small scratch to the shiny side of a disc has on the environment.
CDs and DVDs are made from materials including polycarbonate plastic, petroleum-based lacquer and paints, aluminum and other metals. These materials release chemicals that contribute to environmental and health problems as well as global warming, both when they are produced and when they are destroyed.
The chemical used in CD cases, polyvinyl chloride (PVC), is especially damaging to the environment. It often contains a variety of additives, including lead, making it is the least recyclable, and least recycled, of the major plastics. The Environment Protection Agency (EPA) estimates that less than one percent of post-consumer PVC is recovered or reprocessed. That means the remaining 99% either ends up in landfills or is incinerated, a process that releases damaging dioxins into the air.
Attaching d-skin disc protectors to your CDs, DVDs, games and data immediately eliminates the wasteful and costly need to replace ruined discs. Additional damage is then cut further through the removal of having to back-up data onto blank discs. And if that wasn’t enough the skins themselves are packaged in recycled metal containers specifically designed to be used again as CD carriers. Thus negating the need for harmful post-consumer PVC cases.
There is an ever-increasing awareness by individuals and companies of the need to reduce polluting practices. Protecting your discs with d-skin should be seen as a very small but potentially significant step in the right direction.
